In
1991 Plaintiff was a passenger in the rear-most
bench seat of a 15 passenger van. The van was transporting
the Plaintiff and other students home from a community
school where the Plaintiff was a kindergarten student.
The vehicle was involved in a collision with another
vehicle. The Plaintiff was restrained by a lap belt
which was anchored to the floor of the van.
In
the collision, the lap belt failed at the anchor
point and the Plaintiff suffered fractures to her
skull and other head injuries which left her brain
damaged. Today, Plaintiff has word finding deficits
and difficulty with learning and memory, impacting
school performance. Three defendants in this case
have already settled for $810,000.
At
an arbitration hearing the arbitrator ruled that
the total economic damages to the Plaintiff reduced
to present day value, including past and future
medical expense, future loss earning capacity is
$1,100,000. The total damages to Plaintiff for past
and future pain and suffering is $1,800,000.
